Evergreen Journals Affiliate Program Terms & Conditions
These terms and conditions is a legal agreement between Evergreen Journals Inc. and you ("affiliate"). By signing up to be an affiliate in the Evergreen Journals Affiliate Program ("program") you agree to be bound by the following terms and conditions. Please ensure that you read them carefully before signing up.
Definitions:
Agreement - the contents of the contract between Evergreen Journals Inc. (Evergreen Journals) and the Affiliate in respect to the Program
Program - The affiliate program as set out on the Site and is governed by this Agreement
Affiliate - Party who agrees to take part in the Program
Link - a HTML link provided to the Affiliate to link the Affiliate's website to the Site
Site - www.evergreenjournals.com website
1. The Agreement
1.1. An Affiliate must provide full legal name, valid address, e-mail address and any other information requested in order to create an Affiliate account.
1.2. Evergreen Journals reserves the right to update and change the Terms from time to time without notice.
1.3. Any modifications or changes to the Program shall be subject to these terms.
1.4. You may not use the Program for any illegal or unauthorized purpose.
Violation of these terms and conditions may result in suspension of your rights to be an Affiliate and result in lost commissions and/or removal from the Program.
2. Modification of Evergreen Journals affiliate program terms and conditions
Evergreen Journals reserves the right to modify or otherwise change the terms of the agreement at any time. In the case of any modifications of the terms and conditions in this agreement, it is up to the affiliate to stay updated on the terms of this agreement as Evergreen Journals may change terms without notice from time to time. If the affiliate doesn't accept any modification, the affiliate's option is to end the agreement.
3. Legitimate methods of advertising
3.1. Affiliates are permitted to use links, discount codes, any related banners, or text advertisements provided by Evergreen Journals Affiliate program.
3.2. Affiliates are not permitted to promote any non-affiliate program related materials, such as coupon codes provided in customer newsletters, codes provided to other affiliates, any promotional codes, or codes received from any source other than directly from the Evergreen Journals affiliate program.
3.3. The promotion should include the offer, discount code, link provided by Evergreen Journals affiliate program and expiration date.
3.4. Affiliates must remove invalid codes and banners.
3.5. Affiliate coupon codes and links are not to be promoted on third party websites such as coupon databases.
3.6 Affiliates are permitted to promote their coupon code and link on their personal social media platforms only and must not share this information on any Evergreen Journals social pages.
3.7. Any sales that have been generated through improper promotion, will result in loss of commission and potential removal from the program.
3.8. Affiliate codes will be changed on a frequent basis and affiliates will be contacted with their new code. All old codes must be removed and replaced with the new discount code.
4. Copyrighted material
Affiliate is responsible for ensuring that product descriptions and images comply with all applicable copyright, trademark, data protection, any intellectual property right or any other applicable law. Evergreen Journals will not be responsible if an affiliate uses another party's copyrighted material in violation of law.
5. Payments
5.1. Affiliates receive a commission for sending authorized sales via the individualized coupon code provided by Evegreen Journals Affiliate Program.
5.2. The commission is based on product that is sold. Payments are made once an affiliate reaches minimum of $25 of commissions required for a payout.
5.3. Refunded purchases do not qualify for commission fee.
5.4 Payments may be revoked in the instance that a code is leaked on third party websites. It is the affiliate's responsibility to ensure their code is not leaked.
6. Evegreen Journals Obligations
Evergreen Journals agrees to undertake the following obligations:
6.1. Providing the affiliate with promotional material, such as links, coupon codes, banners and any other graphic materials.
6.2. Processing all orders for Evergeen Journals products placed by following the affiliate's link.
6.3. Tracking the amount of sales generated through the affiliate’s’ link and all social media content via tags and mentions and sharing this with the affiliate in good faith
6.4. Payment processing, cancellations, returns and other related customer service for Evergreen Journals for the purpose of business.
6.5 Providing a journal to affiliates every quarter as requested.
7. Affiliate Obligations
7.1 Affiliates are required to post on their social media platforms on a monthly basis the following content: minimum 1 instagram story (2+ frames) and minimum 1 feed post.
7.2 Each post must contain the tag @evegreenjournals on the photo and in the caption, plus the hashtag #evergreengrove in order for Evergreen Journals to track all content created.
7.3 Affiliate must be following @evergreenjournals
7.4 Failure to follow affiliate obligations may result in affiliate content being overlooked and potential removal from the program.
7.5 If affiliates are unable to complete content, they may contact Evergreen Journals for assistance and provide reasoning.
7.6 Affiliate removal will take place if affiliates fail to oblige with content requirements set forth in this agreement.
7.7 If your main channel of content creation is not Instagram and you are accepted into the program, we will pre-determine what you're posting obligations are.
8. The License
8.1. Evergreen Journals grants to the Affiliate a non-exclusive, non-transferable, revocable right to access Evergreen Journals site though the link in accordance with the terms of this agreement and in connection with the promotional materials provided and authorized by Evergreen Journals.
8.2 Evergreen Journals can use content created by affiliates on social media platforms, website, ads. Influencer will always be credited.
8.3. Affiliates cannot modify or change any materials provided by Evergreen Journals in any way.
8.4. Both parties agrees not to use other's materials in any manner that is misleading, disparaging or in any way portrays the party in a negative light.
8.5. Any inappropriate use of the promotional material may be cause for immediate termination of the agreement.
9. Liability
Evergreen Journals will not be liable to the Affiliate for the defects in the service, interruptions in the accessibility to the service, loss of data on the information handling system or viruses, loss of profits, loss caused by any third party deleting, removing, deactivating or tampering with the Affiliate tracking service or other consequential loss of whether arising from neglect or breach of contract.
10. Termination
The term of the agreement starts upon Evergreen Journals affiliate program acceptance of affiliate's application and can be terminated at any time by either party. This contract can be ended by either party with or without cause at any time, by giving the other party notice of termination in the form of e-mail. Upon the termination of the agreement, the affiliate will remove all links to Evergreen website, as well as all banners and graphic images provided under the Program.
